Welcome to the April 2005 Newsletter from Mi Casa del Mar in beautiful San Felipe!!
The current temperature in San Felipe is 88 degrees during the day and around 66 degrees at night. 
More than seventy thousand vacationers from Mexicali and mainland Mexico were in visiting San Felipe during Semana Santa.  As it is a tradition, the beaches were full of people and live music was provided at the malecon.
                                           
Hobie Cat Regatta weekend 4-6th March
The Hobie Mid-Winters West is an annual event in the San Felipe Bay. Usually held in February, scores of Hobie Cats from all over the United States converge on San Felipe for the three day affair. Associated with the North American Hobie Class Association, the Mid WintersWest event is a well-organized affair that offers participants opportunities to socialize with each other during fish taco dinners and margarita parties.

Spring Break
As every year the S.W.A.T (Summer Winter Actions Tour) brings groups of spring breakers to San Felipe.  This year they brought more than 5000 spring breakers in the last few weeks. Members of S.W.A.T. were anxiously awaiting their arrival as dark grew nearer. They were housed at the El Cortez and Costa Azul Hotels and the management staff of S.W.A.T. were staying at the Las Palmas. Most of the kids were from California and Arizona coming to San Felipe just to party!!  They had private parties at the Rocodile and Beachcomber, the hottest clubs in town and pool parties at the El Cortez Hotel.

Hi Alicia,

I received your newsletter and appreciate obtaining the news from San Felipe.  In the last letter you indicated that a corporation would be better to own land in Mexico than the fideicomiso.  I understand that the fideicomiso is more or less proof of ownership for Americans in purchasing property, as a title for ownership of the property is held in trust by Bancomer.  If a corporation is obtained, what proof of ownership does an American obtain.  I would not want to build unless I knew that I owned the property, and a copy of the title held in trust by the bank would be the proof.  How does that proof of ownership transfer to the corporationis there another paper that an individual would need to verify that,  and how long does it take to obtain that verification after the property transfers and the corporation papers are received?

Dear Bruce,

Thank you for your comments on our newsletter.  Proof of title is provided in a Mexican document called an ESCRITURA.  This document is provided to you by a Mexican Notario (not to be confused with a notary in the US).  The Notario is a lawyer who has apprenticed in his field and is appointed by the state governor.  When the Notario records your transaction, then you legally own the property. 
In order to transfer property, the Notario will review the elements of the transaction and make sure that the necessary documents are provided.  The documents include a survey, appraisal, certificates that there are no liens or back taxes, and existing title documents (escrituras).  Once the Notario records the deal, title has been transferred.
The transfer may take either of 2 forms, direct or bank trust.  Direct title may be held by a Mexican citizen or Mexican corporation.  A foreigner may not take title directly himself.  He can choose a bank trust to hold title (fideicomiso) or he can use his own Mexican corporation.  Mexico allows foreigners to own Mexican corporations.  There are differences between using a corporation or a fideicomiso. The corporation allows greatest control. Any changes such as transfer or sale are performed without a bank resulting on reduced fees and waiting times, the corporations is less expensive and easy to administer that a bank trust (fideicomiso).
